Terms of Service

1. Acceptance of these Terms

By creating an account, uploading data, or otherwise using the TailorFlow service (the "Service"), you ("you", the "Retailer") agree to these Terms of Service and to our Privacy Policy. If you don't agree, don't use the Service.

2. The Service

TailorFlow provides an AI-powered virtual-fitting platform that lets Retailers generate photorealistic renderings of their end-clients wearing custom garments before ordering. Features include the fabric library, Suit Designer visualiser, wedding lookbook, shareable client card and public API. Features may evolve over time; we may add, change or discontinue features on reasonable notice.

3. Your account

  • You are responsible for keeping your login credentials confidential and for all activity under your account.
  • You must be at least 18 years old and legally able to enter into a binding contract.
  • You may not share, transfer or resell your account to another business without our written consent.
  • You must provide accurate business information.

4. End-Client data — your responsibility

You represent and warrant that, before uploading any photograph or other personal data of an End-Client, you have:

  • Obtained the End-Client's informed, written consent to upload their photo and personal details to TailorFlow for the purpose of virtual fitting
  • Disclosed to the End-Client that AI-generated renderings will be produced from their photo
  • Complied with all applicable data-protection laws (GDPR, CCPA, BIPA, and any biometric or facial-data laws in your jurisdiction)
  • Complied with any parental / guardian consent requirements if the End-Client is a minor

You agree to indemnify and hold TailorFlow harmless from any claim, fine or damages arising from your failure to obtain proper consent or comply with data-protection laws in your dealings with End-Clients.

5. Acceptable use

You agree NOT to:

  • Upload photos of any person without their explicit consent
  • Use the Service to generate deepfakes, defamatory content, sexual content, hate speech, or content depicting real people in situations that would cause them harm or embarrassment
  • Use the Service for surveillance, identity verification, face-matching or any biometric purpose beyond virtual fitting
  • Reverse-engineer, decompile or scrape the Service
  • Circumvent rate limits, quotas or authentication mechanisms
  • Introduce malware, spam or automated abuse
  • Resell rendered images to third parties without our written consent
  • Attempt to identify other Retailers' data or exploit our multi-tenant boundaries

We may suspend or terminate accounts that violate these rules without notice.

6. Intellectual property

Your content. You keep ownership of the client photos and data you upload. You grant TailorFlow a limited, non-exclusive, worldwide licence to use, store, process and transform that content solely to deliver the Service to you.

Rendered images. AI-generated renderings produced through the Service are yours to use for the purpose of selling garments to the End-Client depicted, subject to your compliance with these Terms. You may not use them for training AI systems, general marketing of unrelated products, or commercial purposes beyond the fitting/ordering flow.

Our platform. The TailorFlow platform — including its code, fabric library, prompt library, rules engine, UI, brand and documentation — remains our exclusive property. You get no ownership rights beyond the limited licence to use the Service.

Feedback. Any feedback, suggestion or improvement you submit becomes ours to use without obligation.

7. AI-generated content — no guarantee of accuracy

AI renderings are approximations. Colours, patterns, drape, fit and details in a generated image may differ from the final tailored garment. You acknowledge that renderings are illustrative and not a manufacturing specification. TailorFlow is not responsible for garment production quality — that remains between you and the End-Client.

8. Fees and payment

  • Subscription fees, per-render fees and any overage charges are billed via Stripe on the plan you selected.
  • All fees are non-refundable except where required by law.
  • We may change pricing on 30 days' notice at your next renewal.
  • Overdue accounts may be suspended after 14 days.

9. Warranty disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT AI RENDERINGS WILL EXACTLY MATCH THE FINISHED GARMENT.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAILORFLOW'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE FEES YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, LOST-PROFIT OR PUNITIVE DAMAGES. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED (E.G. DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, OR FRAUD).

11. Indemnification

You agree to defend, indemnify and hold harmless TailorFlow, its officers, employees and partners from any third-party claim, loss, damage, cost or expense (including reasonable legal fees) arising from: (a) your breach of these Terms, (b) your unlawful upload or use of End-Client data, (c) your failure to obtain consent, or (d) any garment or business dispute with an End-Client.

12. Termination

Either party may terminate the subscription on 30 days' written notice. We may suspend or terminate immediately for material breach or non-payment. After termination we will delete your data within 30 days, except where we are required to retain it for legal reasons.

13. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which TailorFlow is incorporated. Any dispute shall first be attempted to be resolved in good faith between the parties; if unresolved after 30 days, either party may submit the dispute to binding arbitration or to the competent courts of that jurisdiction. You waive any right to a class-action proceeding to the extent permitted by law.

14. Miscellaneous

  • If any provision is found unenforceable, the rest remain in force.
  • Our failure to enforce a provision does not waive our right to enforce it later.
  • These Terms plus our Privacy Policy and any signed order form or DPA constitute the entire agreement.
  • We may update these Terms; material changes will be notified by email at least 30 days in advance.
